If you're selling or leasing a property with a swimming pool or spa, you must have a Certificate showing whether or not your pool fencing is compliant with legislation.
Vendors are required to supply a valid Certificate of Compliance, attached as a prescribed document to a contract of sale, when selling a property with a swimming pool or spa. If your pool fencing is not compliant, a Certificate of Non-compliance must be supplied.
For newly constructed swimming pools, a valid Occupation Certificate and evidence of swimming pool registration can be attached to the contract in lieu of a Certificate of Compliance.
If you are leasing a property with a pool, it is your responsibility as property owner to ensure that your swimming pool is registered and a valid Certificate of Compliance or Occupation Certificate with provided to the tenant when entering into a residential tenancy agreement.
Before purchasing a property with a swimming pool or spa, you should ensure it has a valid Certificate of Compliance or Certificate of Non-compliance. If you purchase a property with a Certificate of Non-compliance, you will be accepting responsibility to make the pool fencing compliant and gain a Certificate of Compliance within 90 days of gaining ownership.

Once you've completed the Home Swimming Pool Safety Checklist and made any necessary corrections to your swimming pool and fencing, you can apply for a Certificate of Compliance online.
A fee will be payable on application and, should your swimming pool require re-inspection to meet compliance standards, you may be charged an additional fee.

The requirements around the sale and lease of properties with swimming pools or spas do not apply to strata and community schemes comprising more than two lots or off-the-plan contracts.
Access to your property may be required by authorised Council staff in order for us to process your application for a Certificate of Compliance. By submitting your application for a Certification of Compliance, or by authorising its submission you by another, it is assumed you are giving approval for authorised Council staff to enter your property. Should access be required, we will attempt to contact you to make necessary arrangements.
