Local Government Act 1993 Sections 46 and 47

In accordance with Section 47 of the Local Government Act 1993 Lake Macquarie City Council hereby gives notice of its intention to consider granting an easement to drain water over part of Council land known as 5 and 7 Allen Street, Cardiff (Lot 6 DP 13660 and Lot 2 DP 1271611), in favour of the owner of the adjoining land 38 Newcastle Street, Cardiff.

The purpose of the easement is for providing pipes beneath the ground for connection to Council’s stormwater infrastructure. The proposed easement will be 1.845 metres wide and located along the south-west boundary of Council’s land. The proposed easement is to be granted in perpetuity.

The granting of the proposed easement is subject to payment to Council of compensation in respect of the easement.
