Under section 59 of the Environmental Planning and Assessment Act 1979, the Minister for Planning and Environment has approved Lake Macquarie Local Environmental Plan 2014 (Amendment No. Number 34) that became effective on 12 July 2019. This local environmental plan includes an administrative change to the LEP, which affects land throughout the Local Government Area.
The amendment: Repeals Clause 7.12 Development for the purpose of seniors housing which has expired.
Clause 7.12 Development for the purpose of seniors living, came into effect 28 days after Publication of LMLEP 2014 (being October 2014) and ceased to apply 2 years after the commencement of the LEP. The Clause was introduced into the LEP as a transitionary clause from the former LMLEP 2004 to ensure that any existing or proposed Development Applications that had not been assessed by the introduction of LEP 2014 were given the opportunity to be assessed on merit for a further period of two years only. The repeal of Clause 7.12 of the LEP is administrative in nature and merely reflects that the clause has ceased to apply to the Local Government Area.
