Requirements for food business operators
All food businesses in Lake Macquarie City are required to:
- register with Council
- register with the NSW Fair Trading
- in most cases, food businesses must have a Food Safety Supervisor appointed in the business.

What is required to establish a new food business
Specific construction standards and codes apply to food businesses. When planning to open a new food business, contact our Council's Duty Planner to discuss development application requirements. Technical enquiries relating to design and fit-out can be directed to our food inspectors.
New food premises must be constructed and fitted-out in accordance with:
- Australian Standard AS 4674 -2004 Design, construction and fit-out of food premises; and
- Australian New Zealand Food Standards Code.

Purchasing an existing food business
If you are purchasing or taking over an existing business, it is important that you request a copy of the business' current Food Business Inspection Report. The report will provide information from our annual inspections and may include requirements relating to upgrades of building elements, fixtures or equipment.
