If you access the City of Lake Macquarie Online Services it is accepted that you agree to the following terms and conditions and understand the Privacy Notification:
Copyright
The contents of the City of Lake Macquarie Online Services (which includes downloadable material) are subject to copyright and are protected by laws of Australia and other countries through international treaties.
Laws
All matters relating to the City of Lake Macquarie Online Services are governed by the laws of the State of New South Wales, Australia and Commonwealth legislation if appropriate.
Liability
To the maximum extent permitted by law, Lake Macquarie City Council excludes all liability to you for loss or damage of any kind (however caused, including negligence) arising from or relating in any way to the contents of the City of Lake Macquarie Online Services and/or your use of it.
Licence
Lake Macquarie City Council grants you a non-exclusive licence to reproduce the contents of the City of Lake Macquarie Online Services in your web browser (and in any cache file produced by your web browser) for the sole purpose of viewing the content. Lake Macquarie City Council reserves all other rights.
Privacy and access to information
When you access the City of Lake Macquarie Online Services and provide Lake Macquarie City Council with personal information, Lake Macquarie City Council will manage your personal information in a responsible manner for the purpose for which it was collected, and in accordance with the Privacy and Personal Information Protection Act 1998, and Lake Macquarie City Council’s Privacy Management Plan. Lake Macquarie City Council will take all reasonable steps to protect the personal information it holds from misuse, unauthorised access and modification. Any information you supply to Lake Macquarie City Council will also be handled in accordance with the Government Information (Public Access) Act 2009.
Payment security
To ensure that you are trading in a secure environment, Lake Macquarie City Council has contracted the services of CommSecure. CommSecure is the leading provider of electronic commerce payment gateway solutions to NSW local government organisations. Financial records are hosted within the CommSecure system. When you begin to enter payment details, you will notice that you will be taken to a secure site which uses 1024 bit tunnelling encryption to protect your information during transmission. Credit Card Authorisations are transmitted to and from the banking network in seconds. You are informed of the success or failure of your transaction, and Lake Macquarie City Council is given an authorisation and the order details. If there is a hardware or software failure at any stage during the transaction, the transaction is cancelled and no money is debited from your account.
You agree that all of the information you have provided to Lake Macquarie City Council in relation to the transaction is complete and correct, including, without limitation, information provided by you in relation to your credit card details and its validity dates, and is not listed on any warning bulletin held by any bank or credit card provider. You agree that you will comply with any requirement of your credit card provider which may relate to the use of this online service, including without limitation, not exceeding any transaction limit on your credit card used for the transaction. Lake Macquarie City Council has no obligation to provide products or services to you until your credit card provider has authorised the transaction or where Lake Macquarie City Council has any reason to suspect that you are not so authorised to use those credit card details.
Privacy notification
If you provide Council with personal information it will be handled in a responsible manner and in accordance with relevant privacy legislation. Details such as your name and address provided in correspondence, submissions or requests (verbal, electronic or written) may be viewed by Council staff, Councillors or members of the public, unless access is restricted under the Government Information (Public Access) Act 2009. This includes information contained in some documents which may be available via Council’s website, eg Development Applications. Council reserves the right to reproduce in whole or in part any correspondence or submission. In your correspondence to Council the inclusion of your contact details is voluntary, but choosing to omit this information may limit Council's ability to help you.
