A Release of Covenant (under Section 88 of the Conveyancing Act 1919) is required to release a restriction on the use of land or a positive covenant.
For example, you may wish to remove a restrictive covenant that burdens your land for an Asset Protection Zone (APZ) for bushfire protection where circumstances mean the APZ is no longer necessary. You may also use this application to create new covenants and easements. For example, you may need to register a drainage easement on title to comply with a condition of a Development Consent.
